The American Foundation for Suicide Prevention (AFSP) (www.AFSP.org) on February 7, 2007 issued a protest statement to General Motors Regarding Super Bowl Ad In response to a Super Bowl commercial by General Motors Corp., in which a GM factory robot "obsessed about quality" imagines jumps off a bridge after being fired for making a mistake, AFSP contacted the automaker, CBS and the NFL regarding the “insensitive nature of this ad.” AFSP stated “The ad, prominently displayed on the GM website, is offensive to the tens of millions of survivors of suicide loss nationwide. In its carelessness, it portrays suicide as a viable option when someone fails or loses their job. This is the wrong message to send to adolescents in general, or to young people and adults alike who may be depressed and thinking that suicide is their only option, rather than seeking help.” AFSP has requested that GM “pull this ad and cease any further promotion and marketing of it, including taking it off the company's website. Las Vegas (pictured above from the roof of the Rio Hotel and Casino), is the site of this week’s NBA All Star game. With a population of 1.8 million, Las Vegas is one of our fastest growing cities and is ranked the 22nd largest city in the US.

According to the 2000 Census the median income for a household in the city was $44,069, and the median income for a family was $50,465. Males had a median income of $35,511 versus $27,554 for females. The per capita income for the city was $22,060. About 8.6% of families and 11.9% of the population were below the poverty line, including 15.4% of those under age 18 and 8.3% for those 65 or over. With its steady growth in population, Las Vegas nonprofits and governmental bodies faces many challenges in meeting the needs of its growing population.

TWPOC.com believes charities (nonprofits) should only operate in the public interest. That is why nonprofits are granted tax-exempt status. We have created our TWPOC.com E-mail “Whistleblower Hotline” to assist individuals in providing anonymous information about any unethical behavior by a nonprofit; foundation; staff member; Board member; supporter or contractors, etc.

All correspondence to the “Whistleblower Hotline” is kept in strict confidence and may or may not be published; but the source of the information will always not be identified, without the written consent of the source.

Let us know if you know of nonprofit waste, or of a charity scandal; have evidence of unethical behavior or conflicts of interest; know of misappropriations by a 501 c 3 or 501 c 4;.know of a charity operating without proper registration with a State regulatory body or the IRS; have evidence of self-dealing; or, know of labor laws being broken.

We confirm facts with at least two parties before publication. We know from experience that the vast majority of charities operate sound ethical programs. However, charities are operated by humans, with both good and bad results.

Whistlebower Speaks Out (we have altered this story to protect the confidentiality of the Source and have forward the information to the California Attorney General’s office (Please see related story on California Raffles under the Government Column)

“Organization X has been conducting a raffle since October 2006 and just registered at the Attorney General's office a few weeks ago, even though they had already been selling the raffles for four months. Also, the original raffle tickets they used were illegal, of which they sold over $2000 worth. They were illegal due to not having a detachable stub to each ticket nor a corresponding ticket number on either the ticket or stub. They are also selling the raffle tickets at a horse track, which is illegal, and announcing the winner there. They are selling them along with another nonprofit that have totally different raffle tickets, and pulling the winner from the combination of both put together.

“They hired a fundraising consultant, who is a close friend of many years of one of the directors-I don't think they got the required three bids before choosing this consultant. They hired her because she was the director’s friend.

“The board of directors has at least three directors that have been on both the board and staff for over 10 years…. They are aware of the raffle regulations but are hoping they won't get caught. I know this because I was an employee up until today, and although I was given a different reason, I think that I was let go because I warned them of these violations. I don't want my job back-I just think their unethical behavior should be reported. I hold my responsibilities as an employee of any nonprofit very seriously. Although Organization X itself is a wonderful place, the administration staff isn't.”

Spitzer

In late December, former New York Attorney General Elliot Spitzer (now Governor) issued the following press release about telemarketing campaigns: ANNUAL REPORT SHOWS HOW TELEMARKETERS PROFIT FROM CHARITABLE GIVING--

Spitzer Urges Donors to be Make Informed Charitable Donations

Attorney General Elliot Spitzer today released a report which reveals that, on average, only a little over a third of the money raised by telemarketing campaigns goes to charity while the balance is used to pay fees and expenses associated with the fundraising. The 12th annual report, Pennies for Charity, Where Your Money Goes: Telemarketing by Professional Fund Raisers summarizes information filed with the Attorney General's Charities Bureau by professional telemarketers who conducted fundraising campaigns in New York State in 2005. In 2005, telemarketers raised $189.6 million through the 582 telemarketing campaigns included in the report. Charities retained $73.2 million, or 38.61 percent, of the funds raised. The remainder

- $116.4 million - was paid to the telemarketers as fees and other costs of the campaigns. "This annual report should serve as a reminder of the need to make informed decisions before contributing hard-earned dollars to charity," Spitzer said.

The report identifies the following professional fundraisers whose campaigns, on average, yielded the least amount for charity - less than 15 percent of the funds raised: S & E Marketing Ltd - 10.00 percent; DialAmerica Marketing - 10.65 percent; Theodore Productions - 11.11 percent; Allen C. Hill Productions - 12.00 percent; Xentel, Inc. 13.11 percent; Data Communications, Inc. 13.14 percent; Xentel America, Inc. - 13.15 percent; Bee LC - 14.39 percent; Reese Teleservices, Inc.- 13.49 percent; LAS LLC - 14.47 percent; and New Liberty Promotions, Inc. - 14.85 percent.

Spitzer said, ‘I urge charitable organizations to seek bids from several professional fundraisers to ensure that the organizations' fundraising campaigns yield the most money possible for charitable programs’ ’Among the other significant findings of the Attorney General's report are: In only nine percent of the fundraising campaigns did the charity retain at least 65 percent of the money raised, the amount deemed acceptable under the Better Business Bureau's standards for charitable organizations; Charities received less than half of the funds raised in 75 percent of the 2005 telemarketing campaigns; and Twenty-three charities actually lost money and five received no money at all under their fundraising contracts. The information contained in the Attorney General's report pertains solely to telemarketing campaigns conducted by charitable organizations registered to solicit contributions in New York.

California Charitable Raffles

In California, charities and certain other nonprofit organizations may conduct raffles to raise funds for beneficial or charitable purposes in the state. This exception to the general constitutional prohibition against lotteries requires that at least 90 percent of the gross receipts from these raffles go directly to beneficial or charitable purposes in California. Unless specifically exempted, a nonprofit organization must register with the Attorney General's Registry of Charitable Trusts prior to conducting the raffle and file financial disclosure reports on each raffle event.

Read U.S. House member Bill Thomas’ (R, Bakersfield, CA), letter to the NCAA Division 1A, asking about the link of expenditures for athletics and nonprofit tax-exempt status of colleges. Included in the letter was the question: “From the standpoint of a federal taxpayer, why should the federal government subsidize the athletic activities of educational institutions when that subsidy is being used to help pay for escalating coaches’ salaries, costly charter travel, and state-of-the-art athletic facilities?”

An addendum to New Year’s Wishes

Re “New Year’s Wishes” editorial, Jan 1

I read your 28 wishes for the New Year and was surprised, given your coverage in 2006, that there was no mention of the homeless.

How about a wish that the federal government and the state join with Southern California counties, cities and non- profit providers to address the crisis of nearly 90,000 homeless people on Los Angeles County streets, parks and freeway underpasses. Each city and county could commit to building shelters and residences for these forgotten people.
